**Short answer:** Evaluation prop firms are mostly not regulated as prop firms: as of October 2026 we know of no major regulator with a rulebook specific to them. They still fall under general law, such as consumer protection, financial-promotion rules, advertising codes and anti-money-laundering checks, and some large firms now own regulated brokers. Ask a lawyer where you operate and sell.

Unregulated is not the same as unaccountable. A prop firm that is not licensed as a broker still sells a product to consumers, takes card payments, verifies identities and advertises, and each of those brings rules with it.

> This page explains how things generally work and what we've seen running prop firms. It isn't legal, tax or financial advice. Rules differ by country and change often, so ask a lawyer or adviser in your jurisdiction before you act.

## What do regulators say, by market?

**Regulatory signals on evaluation prop firms (as reported; checked October 12, 2026)**

| Market | Signal | Source |
|---|---|---|
| US | CFTC case against MyForexFunds dismissed with prejudice, May 2025; large firms registering as introducing brokers | Willkie; Finance Magnates |
| EU | CySEC chair: ESMA "not currently engaged in any substantive discussions regarding retail prop trading" (June 2026) | Finance Magnates |
| UK | No FCA rule specific to evaluation firms; FG24/1 covers financial promotions on social media; a petition for FCA regulation closed with 24 signatures | FCA; UK Parliament |
| Australia | ASIC "monitoring the emergence of 'prop trading' firms" (2024) | Finance Magnates |
| India | RBI added FundedNext and Smart Prop Trader to its Alert List of unauthorised forex platforms in October 2024 | PTI via The Week |

## Which rules apply anyway?

- Advertising and endorsements: the FTC expects clear affiliate disclosure; the UK ASA expects affiliate content to be identifiable as advertising.
- Financial promotions: in the UK, the FCA warns unauthorised persons promoting a regulated product may commit a criminal offence; whether your product is caught is for a lawyer.
- Hypothetical performance: US futures sites commonly carry the CFTC Rule 4.41 legend where results appear.
- Payments and KYC: processors and identity vendors impose their own checks, and Stripe lists "funded prop trading" as prohibited.
- Consumer law: refunds, subscriptions and unfair-terms rules wherever your customers live.

## What does that mean for a new firm?

Behave as if you were regulated: publish rules before purchase, never change them retroactively, pay on the stated cycle, label trading as simulated and make claims you can source. It is cheaper than a dispute, and it is what traders check before they buy.

## Questions

### Is any prop firm regulated?

Some firms or their groups own regulated businesses, such as FTMO's OANDA and Topstep's introducing broker. The evaluation product itself is usually not a licensed activity, but check each firm's own statements.

### Are futures prop firms regulated?

Not as prop firms in general, but US futures firms work around CFTC and NFA rules, carry the Rule 4.41 hypothetical-performance legend, and some have registered introducing brokers. Ask a US lawyer about your structure.

### Does being unregulated mean prop firms are illegal?

No. It means there is no specific rulebook. General law still applies, and some regulators, such as India's RBI, have treated certain firms as unauthorised forex platforms.
