Prop Firm Regulation News: Dated Tracker (Oct 2026)

Every verified regulatory and platform event that matters to prop firm founders, dated and sourced, plus claims we could not trace. Updated 12 Oct 2026.

Prop firm regulation news moves fast and is often wrong. This tracker lists only events we could trace to a regulator, a court record or named trade press, each with its date. It is written for founders, so it includes platform decisions that act like regulation: when a platform vendor withdraws from a market, firms on it have to change just as if a rule had passed.

For the state of play, read are prop firms regulated; for the outlook, will prop firms be regulated. For what each country requires today, see the jurisdictions index.

What happened most recently?

The table lists verified events from the last 18 months, newest first. "Platform" items are commercial decisions, not law, but they changed what firms could sell.

What is happening in the United States?

The US story is registration by choice, not new rules. After the My Forex Funds case was dismissed with prejudice in May 2025, Finance Magnates reported in May 2026 that US prop firms were "moving inside the CFTC perimeter": Tradeify launched an introducing broker unit, Slay Markets, and Topstep registered with the NFA as a swap firm, after launching Topstep Brokerage as an introducing broker. Platform access is the other pressure: Spotware stopped onboarding US traders through prop firms on 1 July 2026, and ProjectX went Topstep-only in February.

For founders this means a US-facing futures firm should plan its platform and broker relationships as carefully as its rules. Our pages on whether prop firms are legal in the US, the United States and becoming an introducing broker go deeper.

What is happening in Europe and the UK?

Little, officially. CySEC's chair said in July 2024 that prop firms would eventually fall under "a robust regulatory framework", and in June 2026 that ESMA was not discussing retail prop trading. In the UK the petition for FCA regulation gathered 24 signatures. The FCA's rules on financial promotions and finfluencers still apply to anything that promotes a regulated product, so check UK marketing with a lawyer; see are prop firms legal in the UK and our European forex licence guide.

What is happening elsewhere?

Australia's ASIC said in August 2024 that it was monitoring prop trading as a CFD distribution channel, and its October 2026 proposal to extend CFD product intervention to 2037 keeps leverage and margin limits in place for Australian retail clients. India is the strictest signal: SEBI said in November 2024 that prop platforms "are not registered with SEBI", per Finance Magnates. In the UAE, SCA Resolution No. 10 of 2025 requires anyone producing financial content or promotion for the UAE to hold a licence, according to Pinsent Masons, which matters for affiliates. Offshore, the moves have been away from contested licences: prop groups left the Comoros for Mauritius in 2026.

Which "new regulation" stories could we not verify?

Several blog round-ups in 2026 described a CFTC consultation on challenge-based futures firms, an NFA notice, FCA guidance, an ESMA joint statement, first ASIC prop guidance and a joint FCA and CySEC enforcement action, all dated August and September 2026. We could not find any of them on the regulators' own websites as of 12 October 2026, and the ESMA claim contradicts the CySEC chair's June statement. Treat any claimed rule as unconfirmed until you can read it on the regulator's site.

  • Check the regulator's own newsroom or register before acting on any story.
  • Look for a document number, a consultation reference or a court docket.
  • Be wary of round-ups that link only to general regulator homepages.
  • Ask your lawyer to confirm anything that would change your terms or markets.

How should a founder respond to this news?

Build a firm that would pass scrutiny now. Publish rules before purchase and never change them retroactively, label accounts as simulated, keep a dated restricted-countries list, write affiliate terms that ban income claims, and keep two platform routes so one vendor decision cannot stop sales. Our legal documents guide, restricted countries guide and disclaimer generator help. PipValley keeps a dated changelog and trust page on every site we build, from $1,490.

Questions

Is there new prop firm regulation in 2026?

Not a prop-specific rulebook from any major regulator that we could verify as of 12 October 2026. The changes have come through platforms, court cases, voluntary registrations and general rules on CFDs, promotions and finfluencers.

Did the CFTC win its case against My Forex Funds?

No. A New Jersey federal court dismissed CFTC v. My Forex Funds with prejudice in May 2025 and imposed sanctions on the CFTC, as reported by Finance Magnates and Willkie. That outcome concerns that case and is not a general approval of every prop model.

Why are US prop firms registering as introducing brokers?

To offer real brokerage alongside simulated evaluations and to sit inside the CFTC perimeter. Topstep launched an introducing broker and registered as a swap firm, and Tradeify launched an IB unit, according to Finance Magnates in 2026.

Is the FCA going to regulate prop firms?

There is no sign of it as of October 2026. A petition asking for FCA regulation closed in July 2026 with 24 signatures. Existing UK rules on financial promotions still apply to marketing of regulated products.

How often is this tracker updated?

We review it monthly and date every entry. If you see a claimed rule that is missing here, check whether the regulator has published it; we only add items we can trace to a primary or named source.
